Privacy Policy & Terms – Horsed

1. Introduction
Welcome to Horsed, the marketplace for buying and selling equestrian and horse-related items. These Terms and Conditions govern your use of the Horsed app (the "App") and services provided by Horsed. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the App.

2. Eligibility
To use the Horsed app, you must:

  • Be at least 18 years of age or under the supervision of an adult.

  • Have the legal capacity to enter into a binding agreement.
    By using the App, you confirm that you meet these requirements.

3. Account Registration
To access certain features of the App, you may need to create an account. You agree to:

  • Provide accurate and up-to-date information during the registration process.

  • Maintain the confidentiality of your account credentials and be responsible for all activities under your account.

  • Notify us immediately of any unauthorized use of your account.
    Horsed reserves the right to suspend or terminate accounts if any information provided is inaccurate or misleading.

4. Listing Items for Sale
As a seller, you may list equestrian and horse-related items on the App. By listing items, you agree to:

  • Provide accurate descriptions and images of the items you are selling.

  • Ensure that the items you list are lawful, genuine, and do not infringe on the rights of third parties.

  • Confirm that you own the item being listed or have the legal authority to sell it.

  • Comply with applicable laws regarding the sale of goods, including consumer protection laws and import/export regulations.
    Horsed reserves the right to remove any listings that violate these Terms or our policies.

  • agree to post the item within 5 days of sale - items not posted within 5 days will have the order cancelled. Items are automatically marked as posted when received by the courier.

5. Buying Items
As a buyer, you agree to:

  • Pay for items purchased in accordance with the listed price and shipping terms.

  • Review item details, descriptions, and seller policies before making a purchase.

  • Follow the guidelines for disputes and returns if applicable.
    All transactions are final once payment has been processed, except in cases of faulty or misrepresented goods, as outlined in our return policy.

6. Buyer Protection Insurance
To provide additional security for buyers, Horsed applies a 5% fee plus £0.80 on all purchases for Buyer Protection Insurance. This insurance covers buyers in the event of issues such as items not being received, significantly not as described, or fraudulent listings.

  • Claims must be submitted within 48 hours of receiving the item.

  • This fee is non-refundable. Refunds will only cover the value of the item purchased.

  • For returns, postage costs will be payable by the buyer unless otherwise agreed with the seller.

7. Payment Processing & Fees
Horsed uses Stripe as a payment processor, including Klarna for buy-now-pay-later transactions. By using our platform, you agree to comply with Stripe and Klarna’s respective terms and conditions.
Payments can be processed via Apple Pay, credit card, debit card, or the Horsed Wallet.
Sellers are responsible for ensuring they receive payment for their items, and buyers are responsible for full payment at checkout.
Transaction fees may apply and will be clearly displayed.
Payment disputes are handled by Stripe or Klarna in accordance with their policies.

8. Shipping & Delivery
Sellers are responsible for shipping items promptly and providing tracked postage for all shipments.
Buyers must provide accurate shipping information and are responsible for shipping costs unless otherwise stated.
Horsed is not responsible for delays, damages, or losses during shipping.
All shipping details, including the buyer’s name and address, will be passed on to Shippo for the purpose of processing orders.

9. Returns & Refunds
Right to Cancel:

  • As Horsed operates a marketplace where goods are bought and sold between users (buyers and sellers), the right to cancel does not apply under the Consumer Contracts Regulations.

  • Buyers may not cancel purchases once made, except in cases where items are not as described or not as shown in the listing pictures.

  • Returns are only accepted if the item is significantly misrepresented or not as described in the listing. This will be determined at the discretion of Horsed Support.

Refunds:

  • Refunds will only be issued if clear evidence shows the item was misrepresented, faulty, or not as described by the seller.

  • Return postage costs will be payable by the buyer unless otherwise agreed with the seller.

  • Horsed will facilitate communication between the buyer and seller to resolve disputes, and our decision is final.

10. User Conduct & Prohibited Actions
Users of the Horsed platform must adhere to the following conduct guidelines:

  • Providing accurate and truthful information when listing items for sale.

  • Not engaging in fraudulent transactions or deceptive practices.

  • Not manipulating prices, ratings, or feedback to gain an unfair advantage.

  • Not violating intellectual property rights.

  • Not engaging in harassment, hate speech, or offensive behaviour.
    Horsed reserves the right to remove listings, suspend accounts, or take legal action against users who violate these guidelines.

11. Account Suspension & Termination Policy
Horsed reserves the right to suspend or terminate accounts if:

  • A user violates our User Conduct & Prohibited Actions policy.

  • Fraudulent activities, price manipulation, or misleading actions occur.

  • A user’s behaviour brings detriment to Horsed’s reputation, operations, or community.
    Suspended or terminated users may appeal by contacting support@horsed.co.uk The final decision remains at Horsed’s sole discretion.

12. Chatbot Assistance
Horsed provides an in-app chatbot designed to assist users with:

  • Finding items on the app.

  • Tracking orders and checking delivery status.

  • Resolving disputes where possible by providing guidance on next steps.
    The chatbot is available to improve user experience but may not always provide complete resolutions. Final decisions on disputes remain with the Horsed support team.

13. Intellectual Property
All content on the App, including text, images, logos, and software, is owned by Horsed or its licensors and is protected by intellectual property laws. Users may not copy, distribute, or create derivative works of any content without prior written consent.

14. Dispute Resolution
Disputes between buyers and sellers should first be resolved directly.
If unresolved, Horsed may facilitate mediation, and our decision is final.
Legal disputes will be handled through binding arbitration, except where prohibited by law.

15. Limitation of Liability
Horsed is not liable for damages, losses, or claims arising from:

  • Transactions, user interactions, or shipping issues.

  • Content inaccuracies or platform availability.
    We do not guarantee uninterrupted access to the App and may modify or discontinue services at any time.

16. Privacy Policy & Data Collection
Your use of the App is governed by our Privacy Policy, which details how we collect, use, and protect personal information.
External advertisers may use cookies or tracking technologies for content personalization and ad performance.
We collect personal data, including name and address, which is passed on to Shippo for the purpose of fulfilling shipping orders.
Payment details are securely handled through Stripe, which ensures compliance with payment security standards.

17. Changes to Terms
We may update or revise these Terms at any time. Changes will be posted in the App with an updated "Effective Date." Users are encouraged to review the Terms periodically.
